Terms of Use and Licensing for our SP4, SP5 and other SP Scanners (all versions except the SP3) (hereafter SP Scanners) and related software:

 

Important: You must accept the terms use, licensing and limitations listed below before you can use these products.  If you accept these terms you may proceed and downloading will be your acceptance.  If you do not agree to all of the terms, do not download or install the software or use the scanner; you must return the product to ScannerPal, Inc.

 

1. Software Libraries

With an SP Scanner you purchase from ScannerPal, Inc., you as licensee will receive an authorization code to download the software libraries we provide for the SP Scanner.  These libraries are the property of ScannerPal, Inc. Copyright protection is claimed under US and foreign copyright laws and we reserve all rights, except as stated herein.  Additional information we may later provide to you to aid in your use of the software is also proprietary and subject to these protections.  We grant to authorized users of SP Scanners the limited non-exclusive license to use these libraries with one SP Scanner.   No right is given to copy, or modify the libraries or to create derivative works for use with scanners not manufactured by ScannerPal, Inc.  It is the licensee’s responsibility to determine if the ScannerPal software conflicts with other software used, and any resulting difficulties or damages are the responsibility of the licensee.  If the licensee makes derivative works or modifies ScannerPal products, ScannerPal, Inc. shall have no responsibility for any damage or harm caused by installation or use.

 

2.  Sample Application

With your SP Scanner you as licensee will also receive a very basic application.  ScannerPal, Inc. does claim this sample application as proprietary and does claim protection under US and foreign copyright laws.  However, as purchaser or authorized borrower, you are given the right to modify and make derivative works using the sample application in connection with SP Scanners.   It is the licensee’s responsibility to determine if the ScannerPal software, and such software as modified, conflicts with other software used, and any resulting difficulties or damages are the responsibility of the licensee.  Any derivative version of ScannerPal’s sample application may be sold by you or transferred by you for use exclusively with a ScannerPal, Inc. product. 

 

3.  SP Scanner Hardware

SP Scanners contain intellectual property and proprietary information of ScannerPal, Inc., and others, some of

which is covered by issued or pending patents of ScannerPal Inc. and its business associates.  No ownership interest in any intellectual property rights pass from ScannerPal, Inc. or its business associates to subsequent recipients of the products and recipients shall not use the product for the purpose of copying, reproducing, infringing, or reverse engineering the technology or knowingly sell the product to any third party for those purposes.

All duties and taxes related to the use, resale, or import/export of the ScannerPal, Inc. Products are the responsibility of the customer.

These commodities, technology or software may be exported from the United States in accordance with the Export Administration regulations. Diversion contrary to U.S. law prohibited.

 

4.  Limitation of Warrantees and Damages:
ScannerPal, Inc., shall not be responsible for economic damages of any kind as a result of a defect in product design or manufacture, but will repair or replace any product it has manufactured for one year after purchase, and will pass through any available warrantees for products it does not manufacture to Purchasers. In the event of inconsistency between this paragraph and similar provisions on documents from ScannerPal accompanying the product, the documents accompanying the product shall control.
